  32. and international treaty provisions.  You must treat this
  33. software just like a book, except that you may copy it onto a
  34. computer to be used and you may make archival copies of the
  35. software for the sole purpose of backing up our software and
  36. protecting your investment from loss.

  39. this software may be used by any number of people, and may be
  40. freely moved from one computer location to another, so long as
  41. there is no possibility of it being used at one location or  on
  42. one computer while it is being used at another.  Just like a book

  44. the same time, neither can the software be used by two different
  45. people in two different places at the same time (unless, of
  46. course, Borland's copyright is being violated).

  48. DEMO SOFTWARE

  50. The software is a "demo" release of a Borland development product.  The
  51. software and programs that you compile using the software (i.e., contain
  52. any portion of Borland code) are for your own personal use.  Should you
  53. desire to distribute compiled programs to others, you will need to first
  54. upgrade to a regular release of the Borland development product.  You are
  55. of course not restricted from distributing source code which is entirely
  56. yours.

  58. You shall remain solely responsible for, and will hold Borland harmless from,
  59. all claims, liability and damages arising from your own programs which
  60. include any of the Borland code.

  62. LIMITED WARRANTY

  64. Borland warrants the physical diskette(s) and physical documentation
  65. enclosed herein to be free of defect in materials and workmanship for a
  66. period of sixty days from the purchase date.  If Borland receives notification
  67. within the warranty period of defects in materials or workmanship, and such
  68. notification is determined by Borland to be correct, Borland will replace the
  69. defective diskette(s) or documentation.

  71. The entire and exclusive liability and remedy for breach of this
  72. Limited Warranty shall be limited to replacement of defective
  73. diskette(s) or documentation and shall not include or extend to
  74. any claim for or right to recover any other damages, including by
  75. not limited to, loss of profit, data or use of the software, or
  76. special, incidental or consequential damages or other similar
  77. claims, even if Borland has been specifically advised of the
  78. possibility of such damages.  In no event will Borland'sliability for any
  79. damages to you or any other person ever exceed
  80. the lower of suggested list price or actually price paid for the
  81. license to use the software, regardless of any form of the claim.

  84. OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT

  94. have others which may vary from state to state.  Some states do
  95. not allow the exclusion of incidental or consequential damages,
  96. or the limitation on how long an implied warranty lasts, so some

  99. GOVERNING LAW AND GENERAL PROVISIONS

  101. This license Statement and Limited Warranty shall be construed,
  102. interpreted and governed by the laws of the State of California
  103. and any action hereunder shall be brought only in California.  If
  104. nay provision is found void, invalid or unenforceable it will not
  105. affect the validity of the balance of this License and Limited
  106. Warranty which shall remain valid and enforceable according to
  107. its terms.  If any remedy hereunder is determined to have failed
  108. of its essential purpose, all limitations of liability and
  109. exclusion of damages wet forth herein shall remain in full force
  110. and effect.  This License and Limited Warranty may only be
  111. modified in writing signed by you and a specifically authorized
  112. representative of Borland.  Use, duplication or disclosure by the
  113. U.S. Government of the computer software and documentation in
  114. this package shall be subject to the restricted right under DFARS
  115. 52.227-7013 applicable to commercial computer software.  All
